Ebook: Staatszielbestimmungen im integrierten Bundesstaat: Normative Bedeutung und Divergenzen

Stets aufs Neue sind Staatszielbestimmungen Gegenstand verfassungspolitischer Diskussionen auf Bundes- wie auf Landesebene. Vor diesem Hintergrund beschäftigt sich Daniel Hahn nicht nur mit der Frage nach Inhalt und normativer Bedeutung dieser Zielvorgaben im europäisch integrierten Bundesstaat, sondern auch mit den Folgen ihrer Divergenzen. Die Ausführungen basieren auf einem spezifisch normbereichsdogmatischen Ansatz.Zunächst stellt Hahn den Bestand an Staatszielbestimmungen in Grundgesetz und Landesverfassungen dar. Im zweiten Teil analysiert er die Mechanismen der Kollisionsvermeidung und -entscheidung im Geflecht von Bundesländern, Bundesrepublik Deutschland und EU/EG, bevor er der normativen Bedeutung jener Zielbestimmungen nachgeht. Darauf baut der dritte Teil auf, der den Zieldivergenzen und ihren Auswirkungen gilt. Eine wichtige Erkenntnis ist hier neben der Vitalität des Föderalismus bundesdeutscher Prägung die Hinwendung zu einem eher narrativen Konstitutionalismus: Oftmals kann der Staat den hehren Vorgaben keine Taten folgen lassen.Time and time again, the provisions of the Basic Law of the Federal Republic of Germany containing the national objectives are the subject of constitutional debate at both the federal and state levels. In this context, Daniel Hahn examines not only the content and normative significance of these objectives for the federal State integrated into Europe, but also the implications of divergent aims. His remarks take a specifically normativedogmatic approach.Hahn first presents the current catalogue of national objectives contained in the Basic Law and the state constitutions. In the second section, he analyses the mechanisms for preventing and resolving collisions of norms in the network of federal states, the Federal Republic of Germany and the EC/EU, before he discusses the normative significance of the individual objectives. The third section continues on this basis, examining divergencies amongst the objectives and their implications. An important insight here is the turn toward a more narrative form of constitutionalism: the State is often unable to transform such noble objectives into tangible action.
