La financiación de los partidos políticos se ha convertido desde al menos los años setenta en una cuestión central en la política contemporánea. En muchos aspectos un fenómeno internacional que afecta en mayor o menor medida a todas las democracias occidentales, en España la sucesión de escándalos de corrupción relacionados con las finanzas de las grandes formaciones políticas resulta un elemento de enorme importancia para entender el devenir del sistema político. En La financiación ilegal de partidos políticos. Un análisis político-criminal, Manuel Maroto aborda esta compleja cuestión desde diversas perspectivas: tras realizar un recorrido histórico-jurídico por algunos de los distintos escándalos que en esta materia han tenido lugar desde la Transición a la democracia, el enfoque pasa a inclinarse hacia los vínculos entre los modelos de financiación que las formaciones políticas desarrollan, su modelo organizativo y las modalidades de corrupción que aparecen asociadas en esos procesos. Con esto la obra busca trascender la con frecuencia limitada perspectiva jurídico-penal dominante en materia de corrupción, identificando algunos de los problemas estructurales que afectarían al sistema español de partidos, y proponiendo algunas estrategias jurídicas y legislativas de reforma. Factores como la inexistencia hasta la reforma penal de 2015 de un tipo penal de financiación ilegal de partidos o las graves carencias de la función fiscalizadora del Tribunal de Cuentas, entre otros, han reducido a cierta irrelevancia la capacidad de regulación estatal efectiva en la materia, un déficit que la obra sugiere afrontar con una nueva aproximación penal orientada hacia el reforzamiento de los controles internos y la puesta en valor del mandato constitucional de democracia interna.

The financing of political parties has become a central issue in contemporary politics since at least the 1970s. In many aspects, it is an international phenomenon that affects all Western democracies to a greater or lesser extent. In Spain, the succession of corruption scandals related to the finances of the large political formations is an element of enormous importance for understanding the evolution of the political system. In The illegal financing of political parties. A Criminal Policy Analysis, Manuel Maroto addresses this complex issue from various perspectives: after a historical and legal review of some of the various scandals that have taken place since the transition to democracy, the focus shifts to the links between the financing models developed by political parties, their organizational model and the forms of corruption that are associated with these processes. With this, the work seeks to transcend the often limited legal-criminal perspective dominant in matters of corruption, identifying some of the structural problems that would affect the Spanish party system, and proposing some legal and legislative strategies for reform. Factors such as the non-existence until the penal reform of 2015 of a penal category for the illegal financing of parties or the serious deficiencies of the auditing function of the Court of Accounts, among others, have reduced to a certain irrelevance the capacity of effective state regulation in the matter, a deficit that the work suggests to face with a new penal approach oriented towards the reinforcement of internal controls and the enhancement of the constitutional mandate of internal democracy.
